Terms of service

These Terms govern your use of the BetterTalk website and Mac app. Please read them before using the service.

The short version: both people must knowingly agree before a conversation is recorded. BetterTalk gives live, automated guidance and can make mistakes. It is not therapy, medical care, or an emergency service.

1. Agreement to these Terms

These Terms form an agreement between you and the operator of BetterTalk, referred to here as “BetterTalk,” “we,” “us,” or “our.” “Service” means the BetterTalk website, Mac app, related account features, and support.

By accessing or using the Service, you agree to these Terms and our Privacy Notice. If you use the Service for an organization, you confirm that you have authority to bind that organization. If you do not agree, do not use the Service.

2. Eligibility and accounts

You must be at least 18 years old and legally able to enter a contract to use the Service. The Service is intended for two adults using it together.

Give us accurate account information and keep your credentials and devices secure. You are responsible for activity under your account. Tell us promptly at [email protected] if you believe an account or device has been used without permission.

Your BetterTalk account is personal to you. Do not share credentials, register another person without permission, or impersonate someone else.

4. Free hour and subscription

BetterTalk currently offers the first hour of use for free. After that, the current paid offer is $20 per month for the account.

We will not charge you unless you actively complete a checkout. When checkout is available, the purchase screen will show the price, billing frequency, included usage, taxes, renewal terms, and how to cancel before you authorize payment. Those terms control your purchase if they differ from this section.

A paid subscription renews each month until canceled. By subscribing, you authorize the payment provider to charge the payment method you select at each renewal. We may change prices for future renewal periods after giving advance notice. You can decline a price change by canceling before it takes effect.

5. Cancellation and refunds

You may cancel a paid subscription at any time through the account or purchase controls provided with the subscription. If those controls are unavailable, email [email protected]. Cancellation stops future renewal charges. Unless the purchase screen says otherwise, you keep paid access through the end of the current billing period.

Payments are nonrefundable except where the purchase terms say otherwise or applicable law requires a refund. If you believe you were charged in error, contact us promptly so we can investigate.

6. What BetterTalk is, and what it is not

BetterTalk is a conversation practice tool. It uses automated transcription and analysis to show patterns, balance, and possible next moves while two people talk.

BetterTalk does not provide therapy, medical or mental health care, diagnosis, legal advice, crisis response, or emergency services. It does not decide who is right, determine whether a statement is true, or guarantee a relationship outcome. Automated guidance may be incomplete, inaccurate, or poorly suited to a particular situation. Use your own judgment.

Do not rely on the Service when someone may be in danger or when professional help is needed. Contact local emergency services or an appropriate qualified professional for urgent help.

7. Acceptable use

You may use the Service only for lawful, personal conversation practice. You may not:

  • record, monitor, or analyze someone without their informed consent;
  • use the Service to threaten, harass, stalk, exploit, coerce, or harm another person;
  • upload or transmit malware, unlawful material, or content that violates another person's rights;
  • probe, disrupt, overload, or bypass the Service's security or access controls;
  • reverse engineer or extract source code except where applicable law expressly permits it;
  • resell the Service, share account access, or use it to build or train a competing product; or
  • misrepresent automated guidance as professional advice or as a factual judgment about another person.

8. Your content

You keep whatever rights you have in the words and other content you provide. You give BetterTalk a limited permission to carry out the automated processing needed to provide and secure the Service as described in the Privacy Notice. This permission does not create a support or developer right to view your conversation. It ends when processing is complete, subject to the provider retention described in that notice.

You are responsible for having the rights and permissions needed to provide content to the Service. BetterTalk does not use conversation content for advertising or sell it.

9. Privacy and service providers

Our Privacy Notice explains what information is processed and retained. Deepgram processes conversation audio for transcription and speaker separation. Anthropic processes transcript text for analysis. Transcript text passes transiently through a Cloudflare-hosted relay that is designed not to log or store it. Stripe processes payment information when checkout is enabled. Hosting, email, and security providers handle the limited information needed to deliver those services.

Third-party services have their own systems, security practices, and availability. The Security & Privacy page explains the conversation data path and its limits in plain language.

10. BetterTalk ownership

The Service, including its software, design, branding, and original content, belongs to BetterTalk and its licensors. These Terms give you a limited, personal, nonexclusive, nontransferable, revocable right to use the Service while you follow them. They do not transfer any ownership rights to you.

If you send feedback, you allow us to use it without restriction or payment. Do not send feedback that you do not have permission to share.

11. Availability, changes, and termination

We may update, add, remove, or discontinue features. We may suspend access for maintenance, security, legal compliance, nonpayment, or a violation of these Terms. We will make reasonable efforts to give notice when a change materially reduces a paid Service.

You may stop using the Service at any time. We may terminate an account for a serious or repeated violation of these Terms, a risk of harm, fraud, or legal necessity. If we end a paid subscription for reasons unrelated to your conduct, we will provide any refund required by applicable law.

12. Disclaimers and limitation of liability

To the fullest extent permitted by law, the Service is provided “as is” and “as available.” BetterTalk disclaims implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement. We do not warrant that the Service will be uninterrupted, error-free, or suitable for every conversation.

To the fullest extent permitted by law, BetterTalk will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or relationship outcomes arising from the Service.

To the fullest extent permitted by law, BetterTalk's total liability for all claims related to the Service will not exceed the amount you paid for the Service during the 12 months before the event giving rise to the claim. Some jurisdictions do not allow certain exclusions or limits, so parts of this section may not apply to you. Nothing in these Terms limits rights or liability that cannot legally be limited.

13. General terms

These Terms and the policies they link to are the entire agreement about the Service. If a provision is unenforceable, the remaining provisions stay in effect. Our failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent. We may transfer them as part of a reorganization, financing, merger, acquisition, or sale of the Service, subject to applicable law.

We may update these Terms as the Service changes. We will post the revised version and change the effective date. If a change materially affects your rights, we will provide additional notice where required. Continued use after the new Terms take effect means you accept them.
